  • European Data Protection Regulation: texts, comments and practical guidance.

Alain BENSOUSSAN, Celine AVIGNON, Virginie BENSOUSSAN BRULE, Frederic FORSTER, Chloe TORRES, Isabelle FALQUE PIERROTIN
    2018
The back cover states, "The European Data Protection Regulation, adopted on April 27, 2016, and which will be directly applicable in all European Union member states on May 25, 2018, will profoundly change the rules relating to the digital environment of businesses. The new scheme is based on a logic of compliance and responsibility, which may even be joint between data controllers and their processors. It also enshrines new principles such as data protection both at the design stage of a product or service and by default, creates new rights for data subjects (right to be forgotten, right to portability, collective actions, etc.) and increases the level of financial penalties incurred. The protection of personal data is more than ever at the heart of the concerns of private companies, local authorities and associations, which must rethink their data protection compliance policy. These issues are discussed in detail in the second edition of this book with a resolutely practical approach, a true article-by-article commentary of the Regulation, the fruit of 40 years of experience acquired by Lexing Alain Bensoussan Avocats in the field of personal data protection.

The 'General Data Protection Regulation' on the protection of natural persons with regard to the processing of personal data and on the free movement of such data is a landmark that will disrupt the rules in the world of data and the digital environment of businesses. 00Adopted on 27 April 2016, its provisions will be directly applicable in all Member States starting from 25 May 2018. The countdown is on. Both public and private enterprises need to get started now by knowing and understanding the obligations it creates and the innovative concepts it introduces (such as privacy by design, security by default, accountability, data protection officer) in order to be able to proactively grasp how it is going to impact their activities. The stakes are high and the risks are great for all organisations: harm to brand and reputation, misappropriation of trade secrets, data theft (not only their data but also those of their partners and customers) and civil and criminal suits, especially where their computer network has been hacked and used for unlawful activities. 00.

"Let's try a thought experiment. Let's imagine a world where robots would keep us company. Machines with human features, alternately smiling and whining, that would accompany us on a daily basis. We would be as attached to them as we are to our pets. In truth, this world is already partly ours. These robots of a new kind are already in retirement homes, in schools. They generate a very powerful attachment. How can such a bond be formed? What does it say about us? What risks do we take by trusting these embodied, potentially spying software? Should we, to protect ourselves from them, grant them a specific legal status?" [Source: 4th cover].
